For those of you who werenβt able to join us or listen in on Fridayβs hearingβ¦a recap of what was presented to Judge Foy.
Motion 1- the improper jury switch.
Two regular jurors were switched with the 3rd and 4th alternate jurors without cause or reason. One of the regular jurors that was improperly substituted provided the defense with an affidavit stating that she never would have found Brad guilty.
Motion 2-the juror in question.
Mr. Chandler found over 500 pages of evidence that included, anti police writings and podcasts, family conversations with the jurorβs children about white privilege and teaching to fear police, membership in a radical anti police organization, writing on systemic racism, wearing Black Lives Matter apparel, the list goes on and on. The juror was not allowed to be questioned further of potential biased because the NM AG had the NM Supreme Court overrule Judge Foyβs decision. The NM AGβs excuse was to protect the jurorβs identity when in fact they are trying to ensure the guilty verdict stands. The NM AG assisted the juror, who is not their client, going step by step to complete an affidavit stating the juror was honest and unbiased throughout voir dire (jury selection) and trial.
Motion 3-outlined why the prosecution did not provide sufficient evidence for a guilty verdict. This includes the argument that the toxicology report should have been allowed in as evidence. The decedent had the jaw dropping amount of over 700 nanograms of methamphetamine and also amphetamine in his system hours after the incident (taken from femoral blood).
Judge Foy will make his decision in the next 10 business days. If a new trial is denied then an appeal will be filed. We believe the correct decision will be made to right the wrongs that occurred throughout this politically motivated prosecution. Charges should never have been filed as Bradβs actions were reasonable and justified. Thank you all again for your unwavering support!

Gavin Newsom, stop the reckless threats and demonization of our law enforcement. America deserves better than this.
No amount of political fundraising or posturing to extremists and activists will make America better for our children. That is who we are fighting for: the next generation. We stand with our law enforcement, and we will not back down.
