NEWπ : A defense attorney is trying to get charges against his client thrown out by arguing the Trump administration illegally maneuvered to keep Alina Habba as the stateβs top federal prosecutor, despite the expiration of her 120-day tenure. The defense filing, made on Sunday, comes after days of confusion over who is leading the office because of complex and contested rules over filling vacancies.
In the motion, on behalf of a defendant in a drug and gun-related case, attorney Thomas Mirigliano said a workaround Trump officials found to keep Habba was βirregularβ and unconstitutional.
In a nine-page filing, Mirigliano said his client is βfacing an imminent criminal trial proceeding under questionable legal authorityβ and asked for the charges to be thrown out or that Habba and her assistants be barred from exercising further prosecutorial powers in the case.
The problems for the U.S. Attorneyβs Office could grow if other defense attorneys open a flood gate of similar motions. Even if Habba eventually prevailed against legal challenges to her authority as acting U.S. Attorney, there could be months of uncertainty over whether the officeβs criminal cases β some 1,500 a year β could be thrown out or otherwise undermined.

The Los Angeles Police Departmentβs (LAPD) Force Investigation Division is investigating a Law Enforcement Related Injury (LERI) involving Metropolitan Division.
On June 10, 2025, at approximately 2:36 p.m., Metropolitan Division officers assigned to a protest in the Downtown area were moving an unruly crowd south on Alameda Street toward Temple Street. Several uncooperative demonstrators refused to leave the area and confronted officers on the skirmish line, including the suspect, later identified as 30-year-old Daniel Robert Bill.
After several commands to leave, Bill failed to cooperate by physically resisting and challenging officers. Officers used a combination of baton techniques and less-lethal munitions on Bill with no effect. Officers then used a team takedown to take Bill into custody without further incident. After being arrested, Bill complained of pain to his finger.
Bill was transported to a nearby hospital where it was determined that a finger on his left hand was broken, and the injury would require surgical intervention. The surgery was delayed and eventually rescheduled for the following day. As a result, Bill was admitted to the hospital for the fractured finger pending the surgical procedure.
Force Investigation Division (FID) investigators were notified of the hospitalization and are investigating this incident.

Red River Rd after a vehicle drove off of the road and into the ditch. When the officer contacted the driver, the driver opened fire, shooting the officer multiple times. The suspect fled the area on foot. Multiple agencies responded and the investigation is active. The search for the suspect is ongoing.
The officer was immediately transported to receive emergency medical care and has since undergone surgery.

ICE says Jon Luke Evans, who is in the U.S. illegally as a visa overstay, was hired as a cop by Old Orchard Beach PD in ME, and admitted to trying to purchase the gun as part of his job.
ICE says he first entered the U.S. lawfully by flying into Miami on 9/24/23, but never left on his scheduled departure flight on 10/1/2023, overstaying his visa ever since.
Patricia Hyde, the Field Office Director for ICE Boston, which arrested Evans, released a blistering statement to FOX, slamming Evansβ hiring as a police officer:
βJon Luke Evans not only broke U.S. immigration law, but he also illegally attempted to purchase a firearm. Shockingly, Evans was employed as a local law enforcement officer. The fact that a police department would hire an illegal alien and unlawfully issue him a firearm while on duty would be comical if it werenβt so tragic. We have a police department that was knowingly breaking the very law they are charged with enforcing in order to employ an illegal alien. ICE Boston will continue to prioritize public safety by arresting and removing criminal alien threats from our New England communities.β
