*23andMe makes a controversial move that customers won't like*

Genetic testing firm 23andMe appears to be scrambling to cover its bases after it was revealed that a hacker was able to access and leak the DNA data of roughly 6.9 million of its users, a large increase from the 14,000 it reported to the U.S. Securities and Exchange Commission in a court filing on Dec. 1. 23andMe recently sent an email to customers notifying them that the company updated its terms of service on Nov. 30 by revising its "Dispute Resolution and Arbitration" section.Related: Hackers could use your stolen 23andMe DNA data as a weapon “Important updates were made to the Dispute Resolution and Arbitration section to include procedures that will encourage a prompt resolution of any disputes and to streamline arbitration proceedings where multiple similar claims are filed,” the email states. “These updates will go into effect for customers 30 days from the date this email is received.” An arbitration clause removes the right for a party to sue if a dispute occurs. Instead of appearing before a court, the party that feels like they were wronged would have to go through arbitration, which is a private dispute resolution process. The clause also removes the right for any party to appeal the decision. “Dispute Resolution Period must include a conference between you and us to attempt to informally resolve any Dispute in good faith,” reads 23andMe's terms of service. 23andMe customers have already agreed to private arbitration of disputes in the company’s previous terms of service, and even waived their right to file a class action lawsuit. More Technology:Police warn parents about a dangerous new iPhone featureGoogle to start deleting inactive accounts this weekMajor dating apps are yanking their ads from Meta for a disturbing reason Even though the email did not specify what those new changes were specifically to the "Dispute Resolution and Arbitration" section, it appears that customers no longer have the ability to go to court to sue for damages if they weren’t able to settle on a negotiation after arbitration, which was specified in the previous terms of service. It also appears that the language that informs customers that they may not file a class action lawsuit is now in all caps and shortened for clarity compared to the earlier version. “TO THE FULLEST EXTENT ALLOWED BY APPLICABLE LAW, YOU AND WE AGREE THAT EACH PARTY MAY BRING DISPUTES AGAINST THE OTHER PARTY ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A CLASS ACTION OR COLLECTIVE ACTION OR CLASS ARBITRATION.” 23andMe also told users in the email to notify the company within 30 days if they don’t agree with the terms. If they fail to notify the company within that time period, they will automatically be “deemed to have agreed with the new terms.” This latest move from 23andMe comes after a recent report that a class action lawsuit against the company was growing in number as shocked customers learned the full extent of the data breach. 23andMe did not respond to TheStreet’s request for comment in time for publication. *2023 was the most unaffordable year for homebuyers in over a decade*

TheStreet's J.D. Durkin brings the latest business headlines from the floor of the New York Stock Exchange as markets close for trading Thursday, December 7th.Full Video Transcript Below: J.D. DURKIN: I’m J.D. Durkin reporting from the New York Stock Exchange. Markets are digesting a week of mixed jobs data – job openings fell to their lowest level, the private sector added fewer jobs than expected, and weekly jobless claims came in below expectations, indicating that layoffs have not increased. This all comes ahead of Friday’s November jobs report which will give Wall Street a much clearer picture ahead of the Fed’s December meeting. Turning to real estate - if you tried buying a home this past year, you know exactly how tough the market was. And now a new report by Redfin confirms, 2023 was the least affordable year for home-buying since 2012. If you made the median income in the U.S., which is just under $79,000, you would have had to spend 40% of your income on monthly housing costs, that’s if you bought a median-priced home, which was about $400,000. According to one Redfin economist, “A perfect storm of inflation, high prices, soaring mortgage rates and low housing supply caused 2023 to go down as the least affordable year for housing in recent history.” Austin, Texas was the only city that became more affordable in 2023. But Redfin predicts a more friendly environment for home-buyers in 2024, with mortgage rates falling to 6.6% and housing prices falling by 1%. That’ll do it for your daily briefing. From the New York Stock Exchange, I’m J.D. Durkin with TheStreet.

*United Airlines is making one big change for passengers in 2024*

A large number of people who fly on major U.S. airlines do so without benefiting from frequent flyer programs. Depending on the airline, however, somewhere near half of passengers reportedly do take advantage of some aspects of those plans to save money and use perks.Related: A beloved national park is about to get a whole lot more expensive A smaller percentage of those flyers are classified as elite members. And several airlines even offer special programs for the highest revenue customers above normal elite levels. For example, Delta Air Lines (DAL) - Get Free Report has a program called Delta 360, described as an invitation-only service tier for its top SkyMiles members. American Airlines (AAL) - Get Free Report offers one called Concierge Key, which is also invitation only and comes with its Executive Platinum perks and other benefits. Another major U.S. carrier, United Airlines (UAL) - Get Free Report, has an official elite tier above its Premier 1K program called Global Services. Man with a champagne glass flying first class in an airplane seat by a window. Shutterstock United Airlines' Global Services program will soon be more expensive United's Global Services is a program that is essentially a rebranding of its older VIP plan. "The criteria for obtaining this status is generally unpublished, however there are workarounds," wrote travel expert Gary Leff on View From the Wing. "At United prepaying for travel through PassPlus still comes with Global Services status. But that's getting a lot more expensive in 2024." The increased cost means anyone wishing to renew ought to do so before the end of December 2023. "The PassPlus individual program allows you to earn Global Services status for prepaying for $50,000 of United flights," wrote DansDeals. "Unfortunately, we now know that PassPlus individual program rates to receive Global Services status are going up effective 1/1/24 from $50,000 to $75,000."Gaining membership in United's Global Services program For travelers who are not currently members of Global Services that can simply renew, View From the Wing explains the primary ways to get an invitation for it: 4 million milers are granted lifetime Global Services status. Most flyers earn Global Services based on ticket spend, flying a lot on high fares, often with ticket purchases totaling over $50,000 in a year. However actual spend amounts vary. Important travel spend influencers at companies with big corporate deals with United receive Global Services status, and may be able to assign a certain number of these to company employees. Prepaying significant spend for travel through the PassPlus program comes with Global Services. A little more background on the program and eligibility for it are also provided by DansDeals. "United has massively increased the spending requirements to earn elite status, so it has been surprising that Global Services can still typically be earned with about $50,000 in annual spending. The PassPlus changes could be a hint that traditional Global Services qualification requirements will be higher for the 2023 or 2024 status years, but that number is opaque and can vary based on your typical fare class and location," the publication explained. "Either way, passengers won’t know until January 2024 or January 2025 if they qualified for Global Services or not."
